Ebay turns a blind eye on counterfeit luxury products

A French court ordered the California-based online auctioneer to pay 39.9 million euros ($62.9 million) to the luxury goods company LVMH for allowing the sale of counterfeit goods on its site.

eBay will appeal the decision.

This case comes in right after my earlier article entitled eBay Fraud from a few days ago, where we documented a clear case of missrepresentation and may be fraud in connection with a Nokia N95 8GB.

The question is: can eBay be held responsible for the contents loaded by the traders? This reminds us of the case Google had to settle after buying YouTube.

Publishers and Marketplaces usually have a certain degree of responsibility, whatever the disclaimers may be. The question is: how much responsibility and how will the question be dealt with by different countries.
