In my earlier article (new window) I have shown the offer of the seller, where he put up for sale a Nokia N95 8GB and the screenshots show, that in the offer there was no mention nor anything that could lead me to believe, that the offered device was a fake or counterfiet.
The Buyers means
The first thing I did was to contact the seller via the eBay internal mail system, saying that the product I received did not correspond to specifications. Maybe he had been cheated as well?
The seller replied and that knocked me off the chair:

Looking at the sales page on eBay, I cannot see any mention about a China made phone ….
What is worse: the seller knew it was a fake and listed it on eBay, which is clearly against eBay's rules and lets me believe that he intentionally tried to lead me to believe that the phone was real, as per his descriptions and linking to a serious third party website (may be without their agreement).
Based on this reply I reported the transaction to eBay and was then lead to PayPal to ask for a refund.
As I write, the issue has escalated to a claim and I am waiting for the sellers next move:
And for those who have never seen a thing like this, here is PayPal's explanation:

I have been with PayPal for 7 years and in all these years I have never gone through such a situation. Also, I have had accounts with eBay since 2002 and I have never had to complain about a transaction. So if in seven years there is one unsatisfactory transaction, the stats are quite good :-).
However this case is a school case for many eBay related problem areas and I will try to look into some of those in the next article of this series.
